1. Acceptance of Terms

By adding GuessThat (the "Bot") to your Discord server or by interacting with the Bot in any way, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Bot.

2. Description of Service

GuessThat is a free-to-use Discord bot that provides interactive guessing games, trivia, and quiz functionality across multiple game titles, including Fortnite, Valorant, and Minecraft. Features include:

• Solo guessing games (/start)
• 1v1 duels between players (/duel)
• Global mode where multiple players can participate
• Personal profiles, leaderboards, and customizable settings
• Server-specific and global stat tracking

3. Eligibility

You must meet Discord's minimum age requirement (13 years or older, or the minimum age required in your jurisdiction) to use the Bot. By using the Bot, you represent and warrant that you meet this age requirement.

4. Proper Use

When using the Bot, you agree to:

• Comply with Discord's Terms of Service and Community Guidelines
• Use the Bot only for its intended purpose — playing trivia and guessing games
• Not attempt to exploit, abuse, or interfere with the Bot's functionality
• Not use automated systems, scripts, or bots to interact with the Bot
• Not attempt to access other users' data or manipulate leaderboards

5. Intellectual Property

The Bot's source code, website design, and original content are the intellectual property of the Bot's developer. You may not copy, modify, distribute, or reverse-engineer any part of the Bot without prior written consent.

All game assets, names, images, and trademarks referenced by the Bot belong to their respective owners:

• Fortnite — Epic Games, Inc.
• Valorant — Riot Games, Inc.
• Minecraft — Mojang Studios / Microsoft Corporation

GuessThat is not affiliated with, endorsed by, or sponsored by Epic Games, Riot Games, Mojang Studios, or Microsoft Corporation. All game content is used in accordance with fair use for non-commercial, educational, and entertainment purposes.

6. User Data

By using the Bot, you consent to the collection and use of data as described in our Privacy Policy. In summary, we store your Discord user ID, game statistics (wins/losses), user preferences, and temporary duel session data. We do not collect personal information such as email addresses, names, or IP addresses.

7. Availability & Uptime

We strive to keep the Bot available at all times, but we do not guarantee uninterrupted service. The Bot may be temporarily unavailable due to:

• Maintenance and updates
• Discord platform outages or API changes
• Technical issues beyond our control

We reserve the right to modify, suspend, or discontinue the Bot (or any part of it) at any time, with or without notice.

8. Limitation of Liability

The Bot is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Bot
• We are not responsible for any loss of data, including game statistics, due to technical failures
• Our total liability for any claims arising from your use of the Bot shall not exceed $0 (the Bot is free)

9. Termination

We reserve the right to restrict or terminate your access to the Bot at any time, for any reason, including but not limited to violation of these Terms or abusive behavior. You may stop using the Bot at any time by removing it from your server or by not interacting with it.

10. Modifications to Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will be revised accordingly. Continued use of the Bot after changes are posted constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Bot shall be resolved through good-faith negotiation.
